Buying or Selling a Residential Property

Selling - The Steps
- Talk to us before signing any agreement to sell.
- If you are Auctioning or Tendering your property ensure that we have seen and advised you on the Auction or Tender terms and conditions.
- Once the agreement to sell is signed we will:
- Search the title to your property
- Monitor the timely confirmation of any conditions in the agreement in order to attain an unconditional contract.
- Once the agreement to sell is unconditional we will:
- Prepare the documentation for electronic transfer of your property at Land Information New Zealand.
- Arrange for the repayment of any mortgage you have and prepare the documentation for an electronic discharge of your mortgage.
- Prepare settlement statements apportioning rates and allowing for any deposit paid by the Purchaser.
- Attend to settlement on the designated settlement date, repay electronically your mortgage to your Lender and deposit electronically to your Bank Account the balance available to you.
- Report to you on the day of settlement with full statements detailing all of the receipts and payments to and by us on your behalf.
Buying - The Steps
- Talk to us before signing any agreement to purchase.
- We can prepare conditions to insert in the agreement to best protect your interests. You should be aware that once you have signed an agreement to purchase which has conditions which are required to be fulfilled by you, then the law requires you to take all necessary steps to fulfil those conditions.
- If you wish to negotiate a favourable purchase price we can undertake title searches and help you with other matters of a legal and financial nature before you make an unconditional offer.
- Once the agreement to purchase has been signed we will:
- Check the title for you.
- Resolve any title, financial or other matters for you.
- Monitor the timely confirmation of any conditions in the agreement in order to obtain an unconditional contract.
- Once the agreement to purchase is unconditional we will:
- Fully inform you of the best type of ownership of the property depending on what your circumstances are. This may be in your and your spouse/partner’s names as joint tenants or as tenants in common in equal or unequal shares, in a Company or in a Trust. We will also advise you on the need for a Will or perhaps a Property Relationship Agreement depending on your circumstances.
- Prepare the documentation for the electronic transfer and the mortgaging to your Bank of the property.
- Check all financial arrangements, including rates, relating to the transaction.
- Attend upon you prior to settlement to have all documents signed and to run you
through the process of settlement including advising you on your presettlement rights under the agreement. - Attend to settlement on the designated settlement date including the draw down of your loan funds and the payment of the purchase price to the Vendor’s Solicitor.
- Report to you on the day of settlement with full statements detailing all of the
receipts and payments made to and by us on your behalf. - Register the transfer of the ownership to you and the mortgage required by your lender.
